Acceptance of Terms
These Terms of Use (“Terms”) govern access to and use of the Ocean House Management, LLC (“Ocean House”) website located at www.oceanhouseri.com all affiliated web sites, and related guest-facing technologies, applications, digital services, Wi-Fi networks, communications, and online platforms (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Definitions
For purposes of these Terms:
“User” means any individual or entity that accesses, browses, registers for, purchases through, connects to, or otherwise uses the Services, including guests, club members, prospective guests, visitors, and authorized representatives.
“Services” means the Ocean House website located at oceanhouseri.com, affiliated websites, guest-facing technologies, applications, digital services, Wi-Fi networks, electronic communication services, and online platforms operated by Ocean House Management, LLC.
Eligibility
You represent that you are legally capable of entering into a binding agreement and using the Services in accordance with applicable laws.
Permitted Use
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable law or regulation
- Interfere with the operation or security of the Services
- Attempt unauthorized access to systems or accounts
- Upload or transmit malicious software
- Use automated tools to access or scrape the Services without authorization
- Impersonate any person or entity
- Engage in conduct that may harm Ocean House, its guests, or users
Reservations and Transactions
Reservations, purchases, and othertransactions made through the Services may be subject to additional terms, cancellation policies, and conditions presented at the time of booking or purchase.
Ocean House reserves the right to refuse, cancel, or modify reservations when permitted by law or applicable reservation policies.
Intellectual Property
All content available through the Services, including text, images, graphics, logos, trademarks, videos, software, and other materials, is owned by or licensed to Ocean House and is protected by applicable intellectual property laws.
No content may be copied, modified, distributed, displayed, or used without prior written permission except as permitted by law.
User Content
If you submit reviews, comments, photographs, feedback, or other materials, you grant Ocean House a non-exclusive, royalty-free, worldwide license to use, reproduce, display, modify, and distribute such content in connection with business operations and marketing activities.
You represent that you have the rights necessary to provide such content and that it does not violate any law orthird-party rights.
Wi-Fi and Guest Technology Services
Access to guest Wi-Fi and other technology services is provided on an “as available” basis. Users are responsible for:
- Maintaining the security of their devices
- Complying with applicable laws
- Avoiding transmission of unlawful, harmful, or infringing content
Ocean House may suspend orterminate access to guest technology services at anytime for operational, security, or legal reasons.
Electronic Communication Services
To enhance the guest and member experience, Ocean House may provide and utilize various electronic communication services, including but not limited to SMS/text messaging, email communications, private mobile applications, digital identification credentials, mobile room access and door key technologies, online portals, and other guest-facing digital services (“Electronic Communication Services”).
By providing contact information or using these services, you consent to receiving communications related to your reservations, accommodations, membership benefits, property services, events, transactions, security notifications, operational updates, and other information relevantto your relationship with Ocean House.
Electronic Communication Services may be used to: Confirm reservations, appointments, and purchases; Facilitate check-in, check-out, and guest services;
Provide digital room keys, access credentials, and identification services; Deliverable service requests, concierge communications, and property updates;
Notify guests and members of events, activities, promotions, and special offers, where permitted by applicable law;
Provide accounts, membership, billing, or security-related notifications.
Users are responsible for maintaining accurate contact information and securing access to their personal devices, email accounts, and mobile applications. Ocean House is not responsible for unauthorized access resulting from a user’s failure to safeguard their devices, credentials, or accounts.
Ocean House may use third-party service providers to facilitate Electronic Communication Services. Such providers may process personal information on our behalf in accordance with applicable agreements and privacy obligations.
While Ocean House employs reasonable safeguards to protect electronic communications and digital access services, no method of electronic transmission or storage is completely secure. Accordingly, Ocean House cannot guarantee absolute security, availability, or uninterrupted operation of any Electronic Communication Service.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCEAN HOUSE DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCEAN HOUSE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SERVICES.
IN NO EVENT SHALL OCEAN HOUSE’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER, IF ANY, FOR ACCESS TO THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold harmless Ocean House and its affiliates, officers, employees, agents, and service providers from claims, liabilities, damages, losses, and expenses arising out of your use of the Services or violation of these Terms.
Third-Party Services
The Services may include access to or integration with third-party websites, reservation systems, payment processors, social media platforms, and other services. Ocean House is not responsible for third-party services or content.
Modifications
Ocean House may modify, suspend, or discontinue any aspect of the Services at anytime without liability.
Ocean House may update these Terms periodically. Continued use of the Services following anychanges constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to conflict-of-law principles.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
